DAM AND RESERVOIR, COLO. <br /> <br />21 <br /> <br />(h) "Ashcroft Reservoir" means not only the reservoir con- <br />tempbted for construction on Cnstle Creek, a tribut~ry of the <br />Roaring Fork Rivcr, but also, unless the context ~eqUlres ot~er- <br />wise, any other reservoir that may be const.ructed III the Roa!lJlg <br />Fork bnsin above the town of Aspen in lieu of that reservOIr. <br />(i) "c.f.s." means cubic feet of water per second of t!me. <br />2. The Ruedi Reservoir shall be constructed llJld maintained on the <br />Fryingpan River above the wwn of Basalt with an active cal?acity of <br />not less than 100,000 acre-feet. In addition thereto and ill order <br />to offset adverse streamflow conditions on the Roaring Fork Ri.ver <br />"' above the toml of Aspen which might occur as a result of the pr?Ject <br />enhrgement of the Twin Lakes Reservoir, the Ashcroft ReservOIr on <br />Castle Creek, or some re.'3ervoir in lieu thereof, shall be constructed on <br />the Roaring Fork dminage above Aspen to a capacity of approxi- <br />mately 5,000 acre-feet. PI'oviding, however, That t.he Ashcroft Reser- <br />voir shall be constructed only if the S"cretary of the Interior after <br />appropriate study shall detel1nine that its benefits exceed the costs <br />as provided by law, with subsequent authorization by the Congress <br />of the United ~tates and approval by the President. <br />All of such stored water shall be released under the conditions and <br />limitations hereinafter set forth. <br />3. The cost of construction of the Ruedi Reservoir and any other <br />reservoir constructed in addition thereto shall be a charge against <br />the Fryingpan-ArkansllS project to the extent of $7,600,000. The <br />remainmg eost of construction shall be paid in the first instance from <br />Colorado's apportioned share of revenues in the Upper Colorado <br />River Basin Fund and in accordance with Public Law 485: Pro- <br />vidlng, That when the waters stored in allY such reservoir or reservoirs <br />shall be put to a beneficia] use, the users thereof shall pay into the <br />Colorado River Basin fund, to the credit of Colorado's share of such <br />fund, charges for the uses of such waters in accordance with the <br />principles of reclamation law. The cost of perpetual operation and <br />maintenance of the Ruedi Reservoir shall be borne by users of project <br />wllter and users of water stored in Ruedi Reservoir in such propor- <br />tion as may be determined by the Secretllry of Interior. The cost of <br />__~r~etual operation and mllintenance of the Ashcroft Reservoir shall <br />be orne liy users of water from dial. reser\'oir. <br />.> 4. The inclusion of the Ruedi Reservoir in the project shllll not <br />preclude the construction of any other replacement or regu]awry <br />l'e.."en-oirs on the Colorado River or its tributaries above Cameo <br />gaging station. <br />5. The Ruedi Reservoir shall be completed Ilnd in operation before <br />any wllter is diverted to eastern Colorado by means of the project. <br />6. (a) The replllcement capacity of Ruedi Reservoir, and any <br />reservoir constructed in addition thereto, is that portion of the total <br />reservoir cal'acity required to permit project diversions at times <br />when such dIverSIOns could not otherwise be made because of simul- <br />taneous demands (9f seni.or diversions in western Colorado existing <br />at the time of the adopl101: of th.ese operating principles, and shall <br />be so operated to accomplIsh tins rmrpose. Water stored in such <br />capacity shall be released by the UIllted States, upon the request of <br />the Colorado State engineer, to the extent that water would have been <br />
