The Colorado River Water Conservation District of the State <br />of Colorado shaU acquire title to storage of water in Ruedi Reservoir <br />and any resenoir constructed in addition thereto, by appropriate <br />proceedmgs in the courts of the State of Colorado. The Southeastern <br />Colomdo Water Conservancy District of t.he State of Colorado shall <br />likewise acquire tit.]e to the water required hy the project for divcrsion <br />to the Arkausas Valley. The Secretary of the Interior shall at any <br />time after the authorization of the project have the option to obtain <br />or require the transfer to the United States of any and a]l rights <br />initiated or acquired by appropriation as herein set forth: Provided, <br />how.,-er, That the rights so taken sha.II be subject to a beneficial uso <br />of SUell water lIS may be providw. in the repaym\\nt contmct or con- <br />tracts, .and subject. to all the operating principles herein set forth. <br />18. No transmountain diversion of water shall e'"er be made t.hrough <br />the collection and diversion system of the Fryingpan-Arkansas proje.ct <br />in exc""s of the qu.wtitative limitations and conditions established <br />by this document: Provided, ho'we.v.,", That when, ,mder the laws of <br />the State of Colorado, there mal' be additional water avail. LIe for <br />such collection and d.i,'ersion which is not at the time of diversion <br />required for beneficial use in western Colorado or for filling interstate <br />wa.ter compact agree.ments, then such water ma.y be collected and <br />div\\rted for hene.ticia.l use in the Arkansas Valley: Provided, further, <br />That such additional diversion shall only be made with the mutual <br />consent of each of the following agencies of the Stahl of Colorado, <br />to wit: the Colorado 'Vater ConscTvatioll Board, the Sout.hwestern <br />Water Conservation District, the Colorado River 'Vater Conserva- <br />tion District, and the Southeastern Colorado 'Vater Conservancy <br />District. <br />19. To assure project operation in confonnity with the operating <br />principle heretofore sla.ted, to provide a means for the collection and <br />interchange of information and to provide a method for th\\ con. <br />tinued study of project operations to t.he end that, if the stated <br />operating principles may be improved upon, recommendations for <br />changes may be made: to the contracting parties, a commission shall <br />be cr\\at\\d in an appropriOtt.e maIUler to he composed of one repre- <br />sentative of t.he SoutJleastern Colorado Water Conserv,Ulcy District, <br />one repr\\sent.:ltive of the Colorado River 'Vater Conservation Dis- <br />trict, two represent.atives of the United States, and one representative <br />of the State of Colorado appointed by the Colorado WOtt.er Conser- <br />vat.ion Board after consult"tion with the Colorado Game and Fish <br />Commission. The powers of such commission sh"ll be limited to the <br />collection of data., tl", lIlaking of findings of fact, and the suggestion <br />of changes ill operating prillcip!es. <br />These operating principles slwJI be deemed to have amend\\d and <br />take the place of tJlOse opern.t.ing principles signed and executed on <br />April 30, 1950.
