The Ruedi Reservoir shall be constructed and maintained on the <br />-Fryingpan River abo\.e the town of Bas~l~ wit.h an active ?apacity of <br />not less than 100,000 acre-feet. In adehtlOn thereto and III order to <br />.offset adverse stream flow conditions on the Roaring Fork River above <br />the town of Aspen which might occur as a result of the project en- <br />hrgement of the Twin Lakes Reservoir, thc Ashcroft Reservoir on <br />Castle Creek, or some resen'oir in lieu t.hercof, shall be constructed <br />on the Roaring Fork drainage abore Aspen to a capacity of ap- <br />proximately 5,000 acre-feet.: Provid~d, however, That. the Ashcr?ft. <br />Resen'oir shall be const.ructed only If the Secret.ary of the InterlOr <br />after appropriate st.udy shall determine that its benefits exceed the <br />costs. <br />All of such stored water shall be released under the condit.ions and <br />limitations hereinafter set forth. <br />3. The reimbursable cost of construction of the Ruedi Reservoir shall <br />be a charge against. the Fryingpan-Arkansas project. to the extent. of <br />$7,600,000. The renmining reimbursable cost of construction of the <br />Ruedi and Aslle-roft. Reservoirs' or subst.itutes t.herefor shall he returned <br />as if t.hey were part.icipating project.s under t.he act of April 11, 1056 <br />(70-8tat..105), and all net revenues derived from t.heir operation shall <br />be I",id into tile U l'per Culuradu Ri vel' Basin fund as provided in sec- <br />t.ion .5 of said act. The cost of perpetual operat.ion and maintenance <br />of the Rnedi Reservoir shojI be borne by users of project water and <br />users of water stored in Ruedi Reservoir in such proportion as may be <br />det.ermined by the Secreta.ry of t.he Interior. The cost of pel"J)etual <br />operation and m"intenance of the Ashcroft Reservoir shall be borne <br />by users of water from that reservoir. <br />4_ The inclusion of clle Ruedi Reservoir in the project shaU not pre- <br />clude the const.ruction of any other replacement or regulatory reser- <br />voirs on the Colorado River or its tributaries above Cameo gaging <br />station. <br />5. The Ruedi Reservoir shall be completed and in operation before <br />any water is diveIied to eastern Colorado by means of the project. <br />6. (a) The replacement capacit.y of Ruedi Reservoir, and any reser- <br />voir const.ructed in addition thereto, is that. portion of the tot.al reser- <br />voir capacity required to permit. project diversions at times when such <br />dh-ersions could not ot.herwise be made because of simultaneous de- <br />mands of senior diversions in western Colorado existing at the time <br />of t.he adoption of these operating principles, and shall be so operat.ed <br />to accomplish this purpose. Water stored in such capacity shall be <br />rele~sed by the United States, upon the request. of the Colorado St.ate <br />engmeer, t.o the extent. that water wOllld ha,'e been available to said <br />decreed rights except. for stream depletion resulting from diversions <br />by this project. to the Arkansas Valley. <br />(b) The regulat.ory capacit.y of Ruedi Reservoir, and any reservoir <br />constructed in addition t.he.reto, is that portion of the total reservoir <br />capacity not needed for rep\a~ement purposes. Water stored in such <br />category may be sold or leased by the United States to waters users in <br />Colorado for "ny pmpose recognized by the laws of t.he United St.ates: <br />Provided, That. the sale of wawr for use outside the natural basin of <br />t.he Colorado River can anI v be made with the consent of the Colorado <br />River Water Conservat.ion Dist.rict.
