o
0)
CJ1
OJ

of Decision. The Council supports the rec~tion. set torth
in the Record of Decision and urge. that they be carried out.

Environmental Protection Aaencv

The Council appreciates the renewed level of support given
to the Porum, the Council, and the salinity control program in 1989
by the Environmental Protection Agency (EPA). However. the Council
and the Forum do not believe that EPA give. the Hation's most
extensive and successful nonpoint source water, quality control
proqram the support and recoqni tion deserves ,within the higher
levels otits organization.

The Council remains concerned that there has been inadequate
internal coordination at the regional offices and between regional
and headquarters offices during the review of those portions of
environmental documents which relate to salinity control. Of
particular concern is the role of !:PA in the EIS reviews. The EPA
should assure that adequate internal coordination on EIS reviews
,be maintained so that uniform approaches are applied basinwide.
The Council wishes to be advised of any concernsEPA may have early
in the NEPA process to allow adequate and timely opportunities for
the Forum and the Council to become involved in the resolution of
these issues.

The Council remains concerned over the inconsistency in the
approval of the triennial reviews given by the three different EPA
regions of the Basin state submittals. The Council believes that
EPA should provide a consistent and uniform 'approval to the
Basinwide salinity control proqram.

The Council notes that land owner participation under ' the
Department of Agriculture's onfarm salinity control program with
regard to the replacement of wildlife values foregone isvoltintary~
The Council also observes that EPA has continuously expressed
concern that voluntary participation by land owners for habitat
replacement is and will be in the future inadequate. EPA actions
to date have done much to discourage voluntary participation.
There are significant administrative delays to implementing
voluntary proqrams because of the lack of an agreed upon habitat
value procedure. The Council's recommendations concerning this
issue are discussed under general comments.

Of particular concern to the Council is EPA' s opposition to
the issuance of 404 permit for the enhancement of pasture land by
replacement with -open waterwetl"a.nd.'The council understands that
the Corps of Engineers believes the provisions of the required 404
permit meets all necessary requirements and is prepared to issue

7

"

,
'~.
