In 1965, with the knowledge and acquies- <br />cence of the Committee. of Fourteen, the State Department <br />executed through the U.S. Section of the I.B.W.C., with its <br />'Mexican counter-part an executive agreement (Minute 218) in <br />which the United States (while reserving the legal position <br />of the United States on Mexico's claim that the United States <br />deliveries were in violation of the Treaty) gave undertakings <br />which had the effect of delivering to Hexico additional. <br />quantities of water from above Imperial Dam (50,000 acre-feet) <br />over and above the million and one-half acre-feet required by <br />the Treaty. The United States also constructed at its expense <br />a lined bypass channel allowing Hexico to bypass around Horelos <br />Darn the most saline Well ton-Mohawk drainage waters. This }linute <br />remained in effect through 1971 until replaced in July of 1972 <br />by a second agreement (Minute 2~1) which more than dOUbled the <br />amount of substitution waters (to 118,000 acre-feet) delivered <br />to Mexico in addition to the Treaty deliveries. Hinute 2~1 <br />continued in effect until 1tinute 2~2 was approved on August 30, <br /> <br />1973. <br /> <br />The 19~~ Water Treaty contains no explicit state~ent on <br />the quality of the waters the United States is obligated to <br />deliver, but it does provide that the guaranteed 1.5 million <br />acre-feet shall be "waters of the Coloardo River, from any and <br />all sources..."
