<br />uCi1l951. <br /> <br />sections of r~vers that are readily accessible <br /> <br />by road or railroad, that may have some <br /> <br />development along their shorelines, and that <br /> <br />may have undergone some impoundment or <br /> <br />diversion in the past. <br /> <br />~ <br /> <br />Provisions in the Act restrict boundary location to <br /> <br />an average of not more than 320 acres per river mile or an average <br /> <br />of not mOre than one quarter of a mile on ead1 side of the r1.ver. <br /> <br />Not more than an average of 100 acres per mile on both sides of the <br /> <br />river can be acquired in fee title; and if 50 percent of the land <br /> <br />within the. boundaries is public land, fee title cannot be acquired <br /> <br />by condemnation. <br /> <br />Scenic or other easements can be acquired that <br /> <br />are reasonably required to give the public accesS to the river and <br /> <br />to permit its members to traverse the area or of selected segments <br /> <br />thereof. <br /> <br />Scenic easements means the right to control the use of <br /> <br />land (including the air space above such land). for the purpose of <br /> <br />protecting the scenic view from the river, but such easement shall <br /> <br />not interfere with any regular use exercised prior to the acquisi- <br /> <br />tion of the easement. <br /> <br />Water resource development could be curtailed if it <br /> <br />would have a "direct and aelverse effect" on the values for which a <br /> <br />component Or potential component was included in the national wild <br /> <br />and scenic rivers system. <br /> <br />The Federal Power Commission cannot <br /> <br />-5- <br />
