regional views. The first pUblic hearing is scheduled for September 10, in

Annapolis, MD. Other scheduled hearings are: September 12, in San Mateo, CA,

in the West; September 23-24 in Baton Rouge, LA, in the Gulf Coast region; and

September 25 in Omaha, NE, in the Midwest. The times and places for the hearings

will be announced as soon as they are firm.

Following these public hearings, Corps District Engineers throughout the

country will conduct public information meetings to inform the public of the

provisions of the revised regulation and to address local application. Corps

officials will meet with state officials and coordinate activities with regional

offices of the Environmental Protection Agency and other federal agencies.

The revised .regulation was publiShed July 25, 1975, in the Federal Register

in compliance with an order of the U.S. District Court for the District of

Columbia, and became effective on publication. As announced at that time, the

Corps of Engineers plans a moderate and reasonable approach in expanding its

authority in a three-phase program over the next two years.

Phase I, effective July 25, 1975, extends the existing permit procedures now

applicable to traditional "navigable waters of the United States" to include adjacent

wetlands. Phase II, effective July 1, 1976, will expand the permit regulation into

primary tributaries of "navigable waters of the United States," natural lakes

greater than five acres in surface area, and their adjacent wetlands. Phase III,

after July 1, 1977, will extend the Corps' authority into other "navigable waters"

generally up to the headwaters, where the streams flow less than five cubic feet per

second.
