The SJWC wil~ hold <br />its portion of the permit and the wate= rights in confor-aity with <br />applicable law and for the purposes of the revised project. It is <br />the intent of this provision to place the New Mexico participants <br />in the s~e position as the Colorado parties with respect to the <br />project. The parties contemplate that the l:r=fer of ownership <br />....ill be aCCOlllPlished through an agreement between the s.JWC a.nd the <br />Deparbaent of Interior. The S,JWc understands ~d agrees that ~y <br />transfer of ownersh.ip of Permit No. 2683 will onl.y be bindi:1g and <br />effective if the transfer and use of the wate:: under the perm1t are <br />c~ied out in accordance with New Mexico and other app1icable law. <br /> <br />5. Tb.e capital costs associated with the storage and <br />delivery of the Tribes' water supplY shall be reimbursed from power <br />revenues or bo=e by the united states. The Tribes shall continue <br />to be entitled to the quantities of water provided. under the <br />Asreemetlt. pending any lIlOdification for the ESA depletion <br />allowances I the Tri.bes may either store in the Reservoir dY water <br />which they may not deplete or use that water non-consUIIIPtively SO <br />long as that use does not affect tne use of water by the ol:her <br />parties =der paraqrapn 3. The provision of water in accordance <br />wi th the ter1llS of this agrl!eJDent sha1l cocsti tute t:inal. settlement <br />of the tribal water rights. The revised project shaU. be constructed by the Tribes <br />under F.L. 93-638 pursuant to a memora:td= of understanding between <br />the parties which assures that all parties I interests are <br />adequateJ.y protected- <br /> <br />7 _ Only revised ALl' project K & I facilities will be funded <br />through Congressional appropriations. <br /> <br />8. The parties will request Colorado and New Mexico to <br />develop a non-point source water quality progran for t.'le San Juan <br />BaSin. 'rhe parties will cooperate in such a program. The parties <br />will work with the United States to ensure that full enviro:mD.ental <br />cOlllPli.mce is achieV'ed for the revised project. <br /> <br />9.
