1. The parties to this asreement in concept are the San Juan
Watex- COIIllIlission ("S.1WC"), the Anilllas-La plata Water Conservancy
District ("ALPWCD") , the ute Mountain ute Indian Tri.be, the
Southe:rn Indian Ute Indian Tribe (referred to collectively as ("the
Tribes"), and the La Plata Conservancy District (New Mexico). This
agreement in concept is intended to f= the basis for a final
agreement lIlOdifying the Col~ado ute Indian water 1ti.ght:.s Final.
SetUelllent Agreelllent (PeCeIlIber 10, 1986) ("Agreement") and
gove:rn:ing the cons auction of the l'-"........-La plata Project
("P':rOject").

2. tinder this agreement, the ADimas-La P~ata P%oject Will be
modifie<1. The :revised project wll.l include a reduced reservoir at
1ti.dges Basin with a storage capacity of 260,000 acre feet and a
smaJ.ler capacity pumping plant at the cu=ently proposed location.

3. The parties agx-ee to allocate the 57,100 ac:re feet of
annual depletions fx-OIll the Anil!laS-La Plata Project currenUy
al.lowed under ~7 of the Endangered Species Act, 16 V.S.C. ~ 1531 ~

Except as provided in paragraph 4, this aqreemeIl.t shaJ.l not
affect the water rigbts of the parties - The depletion allocations
sha1.l. be transfex-able among water right holders in the San Juan
Basin upon agreement of affected entities, including tile states of
Colorado and New Mexico.
