<br />(7" <br />"'-',,,'1j <br />"i~_'ft;,;~ <br /> <br />Agenda Item 8 <br />August 10, 1990 <br /> <br />Senate Action <br /> <br />The companion bill of H.R. 4498 in the Senate is S. 2807 <br />(copy enclosed). The key features of the Senate bill from the <br />sev~n basin states' perspective are sections 3, 4(b). and <br />5 (b) . <br /> <br />Section 3 of S. 2807 raises the same issue as section 3 of <br />H.R. 4498 in that it directs the Secretary to operate Glen <br />canyon Dam. not just the powerplant. "in such a manner as to <br />protect. mitigate adverse impacts to. and improve the <br />conditions of the natural resources of" the Glen and Grand <br />Canyons. Note. on the other hand, that sections 4(b) and S(b) <br />of S. 2807 specifically refer. unlike the House bill, to "power <br />operating criteria." <br /> <br />The Water and Power Subcommittee of the Senate Committee on <br />Energy and Natural Resources held hearings on S. 2807 on July <br />24. I testified on behalf of the seven states and the Upper <br />Colorado River Commission. The written statement which the <br />states and the commission submitted is enclosed. Please see <br />pages 2-4 for a discussion of the issue raised by sections 3 <br />and S(b) of S. 2807 and the related issue of "flood releases." <br /> <br />Discussion <br /> <br />As of the writing of this memo. the Senate subcommittee <br />chairman. Senator Bill Bradley (D-NJ). has not announced a <br />schedule for mark-up on S. 2807. However, all indications are <br />that the bill is likely to be enacted even though time is <br />running short (Congress is expected to adjourn in early <br />October) . <br /> <br />At the request of Arizona water and power users, Arizona <br />Senators McCain and DeCondini are convening a meeting in <br />Phoenix on September 5 of representatives of the Colorado River <br />Energy Distributors Association (CREDA). the Seven Basin <br />States. and the Grand Canyon Trust. which is the environmental <br />group which has taken a lead interest in this legislation. The <br />purpose of the meeting is to discuss water and power interests' <br />concerns with the bill. The Trust reportedly supports it as <br />introduced. <br /> <br />The states will be represented by Bill Plummer from Arizona <br />and Jim Lochhead and/or Gene Jencsok. In light of the fact <br />that that meeting is occurring immediately prior to the Board <br />meeting.
