The entire tunnel contract is <br />approximately 40 percent con.plete; Hunter Diversion is approximately <br />90 perce~t cvm~lete; Midway Diversion is approximately 20 percent <br />complete; and No Name Diversion is approximately 10 percent complete. <br /> <br />Legal Status <br /> <br />The Board of County Commissioners, Pitkin County Colorado has filed <br />"a civil action (No. 75-M-1268) in the U.S. District Court in Denver <br />claiming that the Final Environmental Statement for the Fryingpan-. <br />Arkansas Project does not comply with the requirements of NL~A. <br /> <br />The suit is now before the court and is being litigated by the <br />Department of Justice. <br /> <br />2 <br />
