Andrus said today he will recommend to the Justice <br /> <br />Department that an appeal be taken from the December 12 decision of U.S. District <br /> <br />Court Judge Charles Hardy in Phoenix enjoining Interior from implementing contracts <br /> <br />with Indian tribes or communities for delivery of Central Arizona Project water. <br /> <br />"Pending an appeal," Andrus said, "the Department will continue its environ- <br /> <br />mental studies and reviews of Central Arizona Project impacts, in the interests <br /> <br />of expediting progress on the project and in accordance with our already expressed <br /> <br />policies." <br /> <br />Judge Hardy granted a preliminary injunction in a suit brought by the State of <br /> <br />Arizona to stay allocations by Andrus of 310,000 acre feet of CAP water to 12 <br /> <br />Indian tribes on December 1. The State and its Department of Water Resources <br /> <br />claim the Secretary's allocations will force municipal and industrial users to <br /> <br />pump more water from diminishing underground supplies. <br /> <br />If Justice appeals, the case would go to the 9th U.S. Circuit Court of <br /> <br />Appeals in San Francisco. <br /> <br />Tribal governments allocated water by Andrus include: Ak-chin, Gila River, <br /> <br />Salt River, Chuichu, Fort McDowell, Camp Verde, San Carlos, San Xavier, Schuk <br /> <br />Toak, Pascua Yaqui, Tonto Apache, and Yavapai. <br /> <br />x <br /> <br />x <br /> <br />x <br /> <br />lNT-1177-81 <br />..1111 IU III IIUIIII IIIIIHI <br />
