>

(ADMINISTRATIVE USE ONLY)

Question 3

What advice can be offered relative to existing applications
for industrial water before the North Dakota Water Board?

The federal government has title to and control of waters impounded

in the main stem reservoirs; however, when waters are sold or taken

from these reservoirs, state laws covering the use and disposition

of these waters become applicable. Therefore, a state water permit
is required. Upon the North Dakota State Water Commission granting a

permit, the federal government's marketing procedures must be met. A
suggestion for this joint marketing assignment is covered under

anS\1er no. 4.

-3-
