A concern was that water use information in the <br /> <br />application could constitute evidence of a partial <br /> <br /> <br />abandonment of the right if historical use was less <br /> <br /> <br />than the full water right. <br /> <br />b. Rules require information on water use during <br /> <br /> <br />four of the last five years because five consecutive <br /> <br /> <br />years is the basis for forfeiture. <br /> <br />2. Identifying the amount of water conserved. <br /> <br />a. A concern was that the amount of water <br /> <br /> <br />conserved could not be accurately predicted prior <br /> <br /> <br />to project implementation. A water user then <br /> <br /> <br />could not predict the economic benefit of the <br /> <br /> <br />proposed conservation project. <br /> <br />b. A two-step process was created. The Department <br /> <br /> <br />sets the percentage allocation of the conserved <br /> <br />water to the user before implementation of. the <br /> <br /> <br />project.
