Provisions of bill <br /> <br />1. Water users can benefit from implementation of a water <br /> <br /> <br />conservation measure by using the owner's portion of <br /> <br /> <br />the water on additional lands or for new uses, or by <br /> <br /> <br />selling or leasing the conserved water. <br /> <br />2. The allocation of water between the water user and the <br /> <br /> <br />state is 75 percent to the user and 25 percent to the state <br /> <br />unless the Water Resources Commission determines that <br /> <br /> <br />another ratio is more appropriate. <br /> <br />3. The water rights for the conserved water are given a <br /> <br /> <br />priority of one minute after that of the original right. <br /> <br />4. The process for selling, leasing or reserving instrearn the <br /> <br /> <br />conserved water right provides a broad range of <br /> <br /> <br />opportunities for the water right holder to obtain <br /> <br />maximum benefit from the right. <br /> <br />5. Conserved water is defined as the amount of water, <br /> <br /> <br />previously unavailable to subsequent appropriators, that <br /> <br />results from conservation measures and cannot be <br /> <br /> <br />i. allocated if doing so would harm another appropriator. <br /> <br />5 <br />
