<br />CADDOA RESERVOIR STUDY <br />June 1940 <br /> <br />STATUS QUO ALLOCATION. <br /> <br />C) <br /> <br />It is stipulated and agreed (Par. 2 of Stipulation). <br /> <br />"That the construction and operation of said dam <br />and reservoir shall not disturb the status quo of the <br />diversion of water for benefioial uses from said <br />Arkansas River by the ditohes and canals now <br />oonstruoted and operated in both of the States of <br />Colorado and Kansas." <br /> <br />, " <br /> <br />- <br />r..;J <br />CO <br />Coil <br /> <br />The said status quo is then defined as follows: <br /> <br />"IT IS UNDi:RSTOOD AND AGREED the.t in order to <br />maintain the status quo of said diver-sion as herein- <br />above ref'erred to there shall be allocated to the <br />State of Kansas for delivery at the State line in the <br />Arkansas River f'rom Colorado into Kansas a quantity <br />of water up to 77,000 acre f'eet annually, of which <br />amaunt 52,000 acre f'eet thereof shall be deliver-ed <br />to the State line during the inigation season from <br />April 1 to October 1 of' each year as and when required by <br />the Kansas State water offioials, and 25,000 acre f'eet <br />thereof to be delivered during the non-irrigati ng <br />season f'ran October 1 to April 1 at such times and in <br />such amounts as same oould be diverted and used for <br />irrigation or storage: amd for irrigation of lands in <br />Colol"ado belovr said reservoi!" a quantity of water up to <br />160,000 acre f'eet annually." <br /> <br />Paragraph 3 of' the Stipulation provides. <br /> <br />"If the flow of' water in the Arkansas River into the <br />reservoir, and into the Arkansas River belovr the <br />!"eservoir f'ran other souroes than the reservoir shall <br />be insuf'fioient to supply the total amount allooated <br />as provided in paragraph 2 hereof: then in that event <br />the said waters shall be pro rated betv~en Colorado <br />and Kansas in the r elation hereinabove in paragraph <br />2 hereof set forth." <br /> <br />SURPLUS ALLOCATIONs <br /> <br />Paragraph 4 of' the Stipulation readsl <br /> <br />"After the allooation of' water as provided in the <br />next; preceding paragraphs, all addi ti onal water whi ch <br />may be impounded in said reservoir, excepting, always <br />the amounts of' water disoharged for flood oontrol pur- <br />poses, hereinafter referred to, shall oonstitute surplus <br /> <br />-3- <br />
