<br />ooi~~~ <br /> <br />il <br /> <br />Water Right Change/Transfer Tax: By statute, water courts could be directed to <br />levy a tax on all water right changes for deposit into a dedicated account. Rates could be <br />specified in the statute or certified to the water court by some other credible means. <br /> <br />INTER-GOVERNMENTAL AGREEMENT: <br /> <br />lbrough an inter-govenunental agreement, public agencies could form and fund the <br />necessary entity to achieve the goals of the program, <br /> <br />CWCB CONSTRUCTION FUND: <br /> <br />Fish and Wildlife Resources Mitigation Account: In 1997, the General Assembly <br />approved changes to the administration of the Fish and Wildlife Resources Mitigation <br />Account within the CWCB Construction Fund. The changes specifically allow interest <br />income to the account to be spent on measures that mitigate the effects of past water <br />development activities on species and habitat protected under the federal Endangered <br />Species Act or thought to be in decline but not yet listed under the Act. <br /> <br />Severance tax: fUnds: In 1996, the General Assembly approved changes in the <br />distribution of severance tax funds. Part of the change involved earmarking $100,000 per <br />year for deposit into the CWCB Construction Fund to support water resource planning <br />activities in energy impacted counties. Application is made each year to the Minerals, <br />Energy, and Geology Advisory Board (MEGA Board). <br /> <br />Grants: The CWCB can award grants from the Construction Fund. It already has <br />awarded two grants totaling $375,000 to the Lower South Platte River Group, Inc. to <br />develop recharge capability on a pilot basis in the lower South Platte River. Grants <br />typically are confined to planning and feasibility work. <br /> <br />Loans: The CWCB makes loans from the Construction Fund for water <br />development and management activities. Repayment terms are established by the Board. <br /> <br />ADMINISTRATIVE OPTIONS <br /> <br />STATE ADMINISTRATIVE STRUCTURE <br /> <br />A separate account could be established by legislation in the Executive Director's <br />Office of the Department of Natural Resources to receive revenue from one or more of the <br />options identified above. Expenditures from the account for Program purposes would be <br />subject to legislative approval annually. <br />
