<br />" <br /> <br />." <br /> <br />Chapter 1 <br /> <br />Introduction <br /> <br />This report was prepared in compliance with the August 11, 1995 order of Arthur L. <br />Littleworth, Special Master, Kansas v. Colorado, No. lOS, Original (U.S. Supreme Court). <br />That order followed a status conference held in Denver, Colorado, on July 27-28, 1995, and <br />directed the State Engineer of Colorado to submit a report to Kansas by September 29, 1995, <br />detailing the actions being taken by and within Colorado to comply with the Arkansas River <br />Compact, including any augmentation plans being developed by entities within Colorado, and <br />any data collection and monitoring programs. <br /> <br />Chapter 8 of this report describes the Amended Rules and Regulations Governing the <br />Diversion and Use of Tributary Ground Water in the Arkansas River Basin (1996 Use <br />Rules), which the State Engineer adopted on September 27, 1995. The 1996 Use Rules are <br />the key to Colorado's efforts to bring about compliance with the Arkansas River Compact. <br />Chapter 8 further describes the efforts that will be made to implement those roles in the <br />coming months. <br /> <br />Chapters 1 through 4 of the report describe additional projects, plans, and regulations <br />that Colorado has undertaken to comply with the Arkansas River Compact. Chapter 2 <br />describes the resources dedicated to the implementation and enforcement of existing and new <br />roles. Chapter 3 gives an account of the inventory of ground water wells in the basin. <br />Chapter 4 describes the data management system that is being developed to ensure <br />compliance with existing and new roles. <br /> <br />In 1994, the State Engineer promulgated Rules and Regulations Governing the <br />Measurement of Tributary Ground Water in the Arkansas River Basin (1994 Measurement <br />Rules). Chapter 5 of this report details the purpose of those roles, enforcement efforts in <br />implementing the roles, the suitability of using the power conversion coefficient method to <br />measure ground water diversions, and the certification program for certifying meter accuracy <br />and determining power conversion coefficients. <br /> <br />Chapter 6 describes the Arkansas River Coordinating Conunittee (ARCC) and <br />positions taken by the conunittee. Chapter 7 describes the entities which are developing <br />plans to replace out-of-priority ground water depletions to senior surface water rights in <br />Colorado and depletions to usable stateline flow. Chapter 9 of the report provides <br />concluding thoughts regarding efforts being taken by Colorado to comply with the Arkansas <br />River Compact. <br />
