<br />, <br /> <br />Enforcement of 1994 Rules <br /> <br />Between July 15, 1994, when the Measurement Rules became effective, and <br />September ll, 1995, more than 2,500 wells have complied with the requirements of the 1994 <br />Measurement Rules. Of these, 276 wells have installed totalizing flow meters, 1,338 wells <br />are rated to determine a power conversion coefficient, and 989 wells are reported as inactive <br />in 1994 (88l have been reported as inactive in 1995.) Another 50 wells appear to be <br />abandoned or have initiated action to change their staws from irrigation to exempt residential <br />uses. Data on monthly amounts of water pumped during irrigation year 1994 (November I, <br />1993 through October 31, 1994) was received for 1,116 wells. <br /> <br />Efforts to enforce the 1994 Measurement Rules have focused primarily on wells in <br />the valley fill and surficial aquifers between Pueblo, Colorado, and the Colorado-Kansas <br />stateline. Many well owners voluntarily complied with the roles by the prescribed deadlines. <br />Owners who failed to comply were issued orders to cease and desist diversions of ground <br />water until they comply with the rules. If they fail to comply with the cease and desist <br />order, a formal complaint is filed in the Water Coun. <br /> <br />The enforcement process is ongoing, with additional orders being issued as <br />information is discovered. As of September 11, 1995, approximately 700 cease and desist <br />orders were issued to well owners for 935 wells which were believed to be out of <br />compliance. As of September 27, 1995, complaints for injunctive relief where filed with the <br />Water Court regarding 238 wells. Of these, 100 wells are now the subject of coun orders <br />to comply, 49 wells are the subject of pending actions, and 88 wells were dismissed from <br />complaints due to compliance (33) or other factors, such as filing suit against the incorrect <br />well owner (55). <br /> <br />Currently, staff is preparing orders to well owners whose wells were reported as <br />inactive in 1994, for which neither a repon of meter installation, power conversion <br />coefficient determination, or affidavit of inactive status has been submitted for 1995. Orders <br />are also being prepared for instances where 1994 pumping data has not yet been received. <br /> <br />18 <br />
