<br />lfThe problem in the Arkanslls River basin in Colo-
<br />rado and Western Kansas is to make available additional
<br />dependnble water for exi.sting irrigation systems and to
<br />regulate the normal stream flow for present vested

<br />There appears in the roport, of course, findings and oonslu-
<br />
<br />sions with respect to the neoessity for flood control and the benefits which
<br />
<br />would be derived therefrom, through the construction of the proposed Caddoa
<br />
<br />Dam.

<br />No recommendations are .contained in House Doownent No. 308
<br />
<br />for the oonatruction or maintenance of reservoir oapaoity for a fish pool.

<br />Aooordingly, the projeot was authori~ed in the national interest and wel-
<br />
<br />fare for flood oontrol benefits and to make available additional water sup-
<br />
<br />ply for existing irrigation systems and to regulate the normal stream flow
<br />
<br />for present vested rights. Thereby the nature and the extent of the public
<br />
<br />interest in storage of water provided by this project was established by
<br />
<br />Congress. It is oonoluded that a chnnge in the determination and defini-
<br />
<br />tioD of what oonstitutes the public interest in such reservoir storage,
<br />
<br />justifying the expenditure of Federal funds, cannot now be made by the War
<br />
<br />Department, without further action of Congress.

<br />Section 4 of the Flood Control Act of 1944 (Public Law 534,
<br />
<br />78th Congress, Chapter 665, second session) provides I
<br />
<br />IISec. 4. The Chief of Engineers, under the super-
<br />vision of the Seoretary of War, is authorized to con-
<br />struot, maintain, and operate public park and reorea-
<br />tional faoilities in reservoir areas under the control
<br />of the War Department, and to per.mit the construction,
<br />maintenanoe, and operation of suoh facilities. * * .
<br />The water areas of all such reservoirs shall be open to
<br />
