<br />Ie. <br /> <br />All depletions are to be distributed over the course of the year consistent with the <br />goal of maintaining a relatively natural hydrograph as described in "Assumptions <br />7 and 8" above. The water remaining after allowing for full compact development <br />to the 3.855 maflevel is available to the Board's instream flow right as Paragraph <br />3 water. A monthly instream flow call trigger will be set as indicated ij <br />"Assumption 5" and described under "Administration I" in order to determine <br />when a call should be placed. <br /> <br />~ <br /> <br />2. Paragraphs 3 and 4 may be defined either in the water right application or by <br />agreement pursuant to the Enforcement Agreement and Board Policy. The amount <br />of Paragraph 3 water is the amount of water physically available for instream flow <br />needs after the Workgroup's development projections to reach the 3.855 maf <br />development level, or such lesser level as may be agreed to, have been protected. <br /> <br />3. The Service may recommend, and the Board may find it necessary to set a lower <br />instream flow limit which can not be violated by any junior water right <br />development which occurs, regardless of hydrologic conditions, in order to protect <br />against a complete dry-up of the river during drought periods to the extent <br />possible with the recovery instream flow water right. It is suggested that the 80% <br />exceedance values recommended by the Service establish this lower threshold <br />value. The intent is that so long as compact water remains to be developed, junior <br />water rights will not have to augment depletions so long as the minimum <br />baseflows or Paragraph 3 flows for the endangered fish are maintained. <br /> <br />Administration: <br /> <br />1. RUNOFF SEASON: To set the "monthly instream flow call trigger"; (1) <br />determine the lowest 10 consecutive year total discharge volume at the Maybell <br />gage for each month of the runoff season, April through July, using the study <br />referenced in "Assumption 3", (2) determine the "lower limit of total consumption" <br />allowance for each corresponding month and multiply it by 10, (3) subtract the 10- <br />year development allowance volume from the lowest 10 consecutive year <br />discharge volume for each corresponding month. The resulting volume becomes <br />the "monthly instream flow call trigger" for determining whether or not a call <br />should be placed during the following month or during the same month in the <br />following year. For example, if the monthly instream flow call trigger was <br />activated in April 1990, the decision would be whether or not to place a call in <br />May 1990 or wait until April 1991 to place the call. The instream flow call <br />trigger would not change unless modified by either the Board or Service. Periods <br />other than a monthly time step could also be used. This approach allows the <br />"monthly instream flow call trigger" and Paragraph 4 water to be modified without <br />modifying the instream flow right. <br /> <br />For purposes of administration during the runoff period, any time the call trigger <br /> <br />11-3 <br />
