e

e

that one way to also resolve the problem is to
actually proceed with a full quantification
Water study. To look at how
much water is really available in the Yampa River for
appropriation. If we find that under the
requirements of the instream flow statutory
guidelines there is a certain amount of water
available for appropriation that is less than their
preliminary recommendations, we could go ahead
perhaps and make the appropriation and say
that-couple of things-one, that is all the water that
is legally available for an appropriation or two and
these might not be either/or it might be together,
but if we have a more finite quantification process
and can know more definitely what the final flow
recommendations are they could corne back and
reevaluate the in stream flow or water availability,
see if there is in fact more water available for
appropriation and file for it or acquire additional
water by some means-I don't someway acquire
additional water that the Service would like to have
for those fish. So basically the request is for you
to discuss all the three or four options that I have
outlined here and then decide whether you want the
staff to go ahead with a water availability for the
Yampa River at this time in conjunction with the
study that is being done on the Yampa same
time. I leave it open to you for discussion with Torn
pitts and John Hamill

Could you comment on the difference in your opinion
between protection of the environment to a reasonable
degree and recovery and survival levels.

8
