We <br />could say there is sufficient data for the Board to <br />make some kind of an appropriation. What this <br />appropriation is I do not know at this time but make <br />a judgment that there is sufficient data, we could <br />file for an appropriation after we have quantified <br />that unknown number at this time and then <br />request-direct the Service in the recovery program <br />continue refining their flow recommendations using an <br />more analytical method. Once that information is <br />available you know fully well what the flow <br />requirements are we could come to Board-the Board <br />could approve-we could make another appropriation <br />with the Board's junior appropriation date and have <br />protection for the fish in that manner. This last <br />approach, if as a number , it would show that <br />we have proceeded in good faith in this effort, we <br />have not used data fully appropriated stream that we <br />might otherwise do and we would have the sufficient <br />progress that the Service is always concerned about, <br />it concerned them about that in the Upper Basin of <br />the San Juan just as mentioned that <br />issue, I guess it was Greg mentioned that issue <br />earlier. So that would be an approach to resolve the <br />impasse that we have, we would need to recognize that <br />the first appropriation would be based on the <br />_ professional and critical data and professional <br />judgment and it would not be the full amount that <br />might eventually be required for the fish. with <br />respect to the Yampa River that I mentioned earlier <br />at your request is that proposal has been made to ask <br /> <br />7 <br />
