Water and Power t~en would consider Fis~ and Wildlife <br /> <br />Service findings and recommendations in the final project plan. <br /> <br />Flood Control Act <br /> <br />T~e Flood Control Act of December 22, 1944 (58 Stat. 887) aut~odzes <br /> <br />t~e construction of certain public works on rivers and ~arbors for flood <br /> <br />control and ot~er purposes. <br /> <br />It does requ~re. ~owever, t~e recognition of <br /> <br />t~e i.nterests and rights of t~e states and the preservation and protection <br /> <br />of t~e nation's "ivers to t~e fullest possil,le extent for all establis"ed <br /> <br />and potential purposes. <br /> <br />It also requires feasibility reports to be <br /> <br />submitted to other agencies for their review. <br /> <br />Executive Orders 11988 (Flood Plain Management) and <br />11900 (Protection of Wetlands) <br /> <br />T"e extent of Executive Order 11988, issued Mav 24, 1977, is to <br /> <br />prevent to the extent possil,le, tl-te aoverse i_mpacts associated wit'" tl-te <br /> <br />occupancy and modification of flood plains and avoi~, SUDport of flood <br /> <br />plain development w~erever a practical alternative arises. It calls on <br /> <br />each agency, in carrving out its responsil,i1ity to reduce the risk of <br /> <br />flood loss, to minimize the impact of floods on ~uman safety, heal.t", and <br /> <br />welfare, and to restore and preserve t~e natural and beneficial values <br /> <br />served bv flood plai.ns. <br /> <br />The President issued Executive Order 11990, also of Mav 24, 1977, t"at <br /> <br />instructs Federal agencies to avoid the adverse impacts associated wit~ <br /> <br />the destruction or modification of wetland$ and to avoid support of new <br /> <br />constructi.on in wetlands wl1enever there is a practical alte!"native. <br /> <br />On Januarv 8, 1980, Water and Power adopted final procedures t"at pro- <br /> <br />vide a description of t~e processes for implementing t"ese two executive <br /> <br />orders.
