SUBJECT WATER RIGHTS <br /> <br />ILl <br /> <br />Backaround <br /> <br />Use of direct flow water rights on the golf course can be generally <br />classified into two categories; 1) those that will continue to be <br />used for irrigation under the pioneer Union Ditch, and 2) those <br />that will be used to irrigate land above the ditch and south of <br />Bear Creek, termed the "new acreage". The city both owns and <br />leases Pioneer Union Ditch rights. The majority of the owned <br />shares are being changed to an alternate place of use for <br />irrigation of the new acreage. City ownership of Hodgson Ditch <br />shares are being changed in point of diversion and place of use for <br />irrigation of the new acreage. These direct-flow water rights that <br />will be used to irrigate the new acreage are defined in this report <br />as the "subject water rights". In addition to the above changes <br />the application in Case No. 90-CW-185 appropriates a new direct <br />flow right for 5 cfs and a storage right for 60 af from Bear Creek <br />for use on the Golf Course, The City'S Division 1 Water Court <br />application, Case No. 90-CW-185, is attached as Appendix A. <br /> <br />II.2 Pioneer Union Ditch <br /> <br />The Pioneer Union Ditch diverts water from the north side of Bear <br />Creek in Section 32, T4S, R69W, below Bear Creek Dam in Water <br />District No.9. In the original District 9 adjudication the ditch <br />was awarded three priorities totaling 45.67 cfs for the purpose of <br />irrigation as shown in Table 1. As a result of six separate <br />decreed transfers out the ditch (Table 2) there is a total of <br />32.0336 cfs remaining in the ditch. <br /> <br />The Pioneer Union Ditch Company is organized as a mutual ditch <br />company with 80 voting-shares of stock or 1,753.728 inch~shares <br />(21.9216 inches/voting-share).
