<br />This language in the Operating Criteria left with the Secretary the burden <br /> <br />of considering all things intended by the law and all things interpreted to be <br />~ <br />intended by the law by the States in their deliberations in formulating the <br /> <br />:'., Operating Criteria, and such other studies as the Secretary deemed necessary <br /> <br />in determining what amount of water that should be in storage in Upper Basin <br /> <br />reservoirs in order to protect the continued development of use of water in <br /> <br />the Upper Basin States under their article III(a) Compact Entitlement, , <br /> <br />without impairment from the deliveries of water under article III (c) and <br /> <br />III(d) of the Compact. Each year when the Secretary has sent to the Governors <br /> <br />of the States and to Congress his report on the operation of the Colorado <br /> <br />River System, in accordance with the Operating Criteria, and his projected <br /> <br />operation for the coming year, he has certified that he has examined all <br /> <br />of the pertinent factors and that before releasing anything more than the <br /> <br />8.23 m;'llion-acre-foot minimum release provided by the criteria, that in <br /> <br />fact there has been sufficient water in storage in the Upper Basin to satisfy <br /> <br />the requirements of section 602(a). <br /> <br />. . <br /> <br />During the seven or eight years the Colorado River System has been operated <br /> <br />under the Operating Criteria many changes have taken place that could have <br /> <br />an impact on the 602(a) storage requirement. New water use projects have <br /> <br />been completed or have been initiated and are partially complete and in <br /> <br />operation. Water rights questions have been raised which could have an effect <br /> <br />on the rate of future depletion in the Upper Basin. The energey crisis has <br /> <br />made more people aware of the role that water in the Upper Basin might play <br /> <br />in the solution to the energy problem through development of the Upper Basin's <br /> <br />". <br /> <br />.' <br />
