This language in the Operating Criteria left with the Secretary the burden

of considering all things intended by the law and all things interpreted to be
~
intended by the law by the States in their deliberations in formulating the

:'., Operating Criteria, and such other studies as the Secretary deemed necessary

in determining what amount of water that should be in storage in Upper Basin

reservoirs in order to protect the continued development of use of water in

the Upper Basin States under their article III(a) Compact Entitlement, ,

without impairment from the deliveries of water under article III (c) and

III(d) of the Compact. Each year when the Secretary has sent to the Governors

of the States and to Congress his report on the operation of the Colorado

River System, in accordance with the Operating Criteria, and his projected

operation for the coming year, he has certified that he has examined all

of the pertinent factors and that before releasing anything more than the

8.23 m;'llion-acre-foot minimum release provided by the criteria, that in

fact there has been sufficient water in storage in the Upper Basin to satisfy

the requirements of section 602(a).

. .

During the seven or eight years the Colorado River System has been operated

under the Operating Criteria many changes have taken place that could have

an impact on the 602(a) storage requirement. New water use projects have

been completed or have been initiated and are partially complete and in

operation. Water rights questions have been raised which could have an effect

on the rate of future depletion in the Upper Basin. The energey crisis has

made more people aware of the role that water in the Upper Basin might play

in the solution to the energy problem through development of the Upper Basin's

".

.'
