<br />00245J <br /> <br />Following delivery of the initial Report described in paragraph 8, on or <br />before April 1 of each year, the River District and the Upper Gunnison <br />District shall provide to the Bureau of Reclamation in Grand Junction, <br />Colorado, or any other location designated by the United States, and <br />to the Colorado State Engineer and Division 4 Engineer, an Annual <br />Report. The Annual Report shall include an updated listing of the <br />names of the diversion or storage structures and priority or <br />administration numbers of the diversions in the areas represented by <br />the Districts which qualify for subordination of Aspinall Unit Rights <br />under the Depletion Allowance described in this Agreement, which <br />separately identifies the structures diversions which have been added <br />to or removed from the listing since the initial Report or previous <br />Annual Report. Each Annual Report shall also include an estimate of <br />the total amount of diversions (in at) and an estimate of the total <br />amount of related depletions (in at) by the listed structures made <br />during the previous irrigation year (November 1 through October 31). <br />The estimates of diversions and depletions contained in the Annual <br />Report shall be derived by the Districts from information compiled by <br />the Division 4 Engineer in the ordinary course of his duties. <br /> <br />As noted in the above Paragraph 9, submittal of this 2001 Annual Report was required <br />by April 1, 2002. The Districts requested, and received from the United States, an extension of <br />the reporting deadline, from April 1, 2002 to January 2, 2003. This extension was required as <br />the result of problems in obtaining data for the required period of record. In addition, the <br />extension was also needed to allow for the State of Colorado to complete its update of the <br />irrigated acreage estimates based off of 2000 Satellite Imagery. <br /> <br />The following information provides the basis for this 2001 Annual Report in satisfaction <br />of the requirements of Paragraph 9 of the Subordination Agreement. This report is divided into <br />four sections: Section 1.0 is the Introduction, Section 2.0 describes the water rights and <br />structures that benefit from the Subordination Agreement, Section 3.0 describes the diversions <br />and depletions associated with these water rights; and Section 4.0 summarizes the results of <br />the study. <br /> <br />2.0 WATER RIGHTS AND STRUCTURES <br /> <br />The purpose of this section is to quantify all of the water rights that benefit from the <br />Subordination Agreement during the 2001 irrigation year. Water rights for minimum instream <br />flow rights, rights for minimum natural lake levels, and any conditional water rights that were not <br />exercised during the 2001 irrigation year were excluded. <br /> <br />The water rights in the area of interest were determined from the water rights tabulation <br />maintained by the Colorado Division of Water Resources (DWR). The tabulation was taken from <br />the Colorado Decision Support System (CDSS) website developed by the DWR. The tabulation <br />report that summarizes the net amount associated with each water right was utilized for the <br />purposes of this report.
