Neither the use nor point of diversion <br /> <br /> <br />of the remainder, 19.67 cfs, has been changed. It is impossible to <br /> <br /> <br />determine what may be done with this right in the future, but a reasonable <br /> <br /> <br />assumption is that the right will eventually be transferred to municipal <br /> <br /> <br />use. In the event of this, undoubtedly the rate of diversion will <br /> <br /> <br />be reduced with the transfer. Reasonably, the amount will be reduced <br /> <br /> <br />to something in proportion to historic use on the land irrigated by <br /> <br /> <br />the Simonton Ditch. A review of the 1952 through 1962 diversion <br /> <br /> <br />records by the ditch indicated an average of 635 acres was irrigated. <br /> <br /> <br />200 acres was dried up in the Evergreen transfer and 155 acres dried <br /> <br /> <br />by the State of Colorado transfer, leaving 280 acres. Average consumptive <br /> <br /> <br />use of irrigation for the Simonton Ditch was calculated to be 1.64 feet <br /> <br /> <br />per year. Based on review of the diversion records, the irrigation <br /> <br /> <br />efficiency is estimated to be 42%. Applying this efficiency and the <br /> <br /> <br />calculated consumptive use to the remaining 280 acres, it was assumed <br /> <br /> <br />that the Denver Water Board may expect to be able to divert at least <br /> <br /> <br />4.50 cfs under their Simonton water right. Utilizing this rate, the <br /> <br /> <br />Evergreen share of the No.2 right is 47%. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />I <br /> <br />The most senior..,ater right in District 9 is the McBroom Ditch " <br /> <br /> <br />right for 11.58 cfs. 10.6 cfs of this right is owned by the City <br /> <br /> <br />of Englewood. This right has never been changed from its original <br /> <br /> <br />use and point of diversion and has historically been util ized to meet <br /> <br /> <br />Englewood's increased demands during the irrigation season. For <br /> <br /> <br />purposes of this study, it is assumed that this right wi 11 be used <br /> <br /> <br />for lawn and golf course irrigation and therefore will be exercised <br /> <br /> <br />for 10.6 cfs during the irrigation season only. <br /> <br />. <br /> <br />. <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />There are various opinions that when, and if, the McBroom Ditch was <br /> <br /> <br />transferred or changed to strictly municipal uses, the decreed amount would <br /> <br /> <br />be reduced significantly. No legal opinion was obtained concerning <br /> <br /> <br />this change, therefore, it would be speculation to assume this will <br /> <br /> <br />happen.
