Because of the volume of computations <br /> <br /> <br />required to develop this type curve using daily flows, gage flows <br /> <br /> <br />were used. <br /> <br />I <br /> <br />I <br /> <br />Evergreen Water System Water Rights <br /> <br />I <br /> <br />I <br /> <br />A list of water rights owned by the Evergreen System is shown <br />in Table 6. The most senior right is for 6 cfs of the No.2 priority <br />right in ~ater District No.9. The next senior right is for 3 cfs <br />of the No.3 priority io the District. The transfer of the 6 cfs right <br />was decreed in 1961, whereby this amount was transferred from the <br />Simonton Ditch. The 3 cfs right was transferred from the Hodgson <br />Ditch by decree dated January 11, 1967. <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />The most senior decree states that 2.94 cfs was abandoned and <br /> <br /> <br />200 acres of land was removed from irrigotion by the Simonton Ditch <br /> <br /> <br />in exchange for the transfer of the 6 cfs. Certain constraints were <br /> <br /> <br />also imposed on the use of the 6 cfs right. Included in t~ese is <br /> <br /> <br />the subordination of the Evergreen diversion right to certain storage <br />., <br /> <br />rights during times when water is not being diverted in District 9 <br /> <br /> <br />for irrigational purposes. This constraint could substantially limit <br /> <br /> <br />Evergreen diversions during non-irrigation periods. <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />In transferring the No.3 right, a total of 159 acres was removed <br /> <br /> <br />from irrigation from the Hodgson and Pioneer Union Ditch irrigated <br /> <br /> <br />lands. A total of 3.988 cfs was abandoned to Bear Creek from the <br /> <br /> <br />Hodgson and Pioneer Union Decrees and 1.163 cfs was abandoned to the <br /> <br /> <br />Pioneer Union Ditch. The No.3 right transfer decree also contains <br /> <br /> <br />the same general constraints stated above for the No.2 water right. <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />The 110.2 right OI.ned by Evergreen is only a portion of the total <br />No.2 right. The original Simonton Ditch decree was for 35.76 cfs. <br />Six cfs was transferred by Evergreen, 2.25 cfs by the State of Colorado <br /> <br />I <br /> <br />I <br /> <br />-16- <br /> <br />I <br />
