<br />IIWBEREAS, subject to ratification and approval by the <br />Congress and by the legislatures of said states the terms of <br />such Compact have been agreed upon by said Connnission as <br />follows: <br /> <br />. <br /> <br />ARTICLE 1, <br /> <br />. <br /> <br />liThe States of Arizona, CaHforilia, Colorado, New. <br />11exioo, Nevada, Utah and "!yorning mutually agree among them- <br />selves and with each other and with the United States of <br />America that with respect to the use, distribution and -utili- <br />zation of the waters of the Colorado Riverai1d itstiibutaries, <br />where such use and distribution within any state may affect <br />the use and distribution made within another state, the'- <br />following general principles shall be recognized and enforced <br />as controlling in all interstate controversies or disputes. <br />relating thereto, any la\i or custom of any' state to the con- <br />trary nothwithstanding. <br /> <br />II~For the purpose of this compact, the <br />Colorado River Basin is. to be regarded as embracing the ehtire <br />watershed of the Colorado. River within the United States and <br />also the Imperial and Coacnella.Va11eys, and is to be consider- <br />ed as one economic unii; and . <br /> <br />IIFor the purposes of this compact and when <br />ueed herein Colorado River shall be understood to include. <br />main stream and all tributaries of that river; and <br /> <br />... <br /> <br />.. <br /> <br />"The application of water for agriculture <br />as used herein shall mean the application of water upon the. <br />land for any purpose, ~There the water is applied to promote <br />the growth of vegetation; and .. <br /> <br />"Power, as used herein, is .understood <br />to mean both water pO~Ter directly applied and hydro-electric <br />power. <br /> <br />"Second. <br /> <br />The following definitions are agreed upon; <br /> <br />. <br /> <br />"(a) By the word "appropriation" as herein <br />used is meant a diversion of water from its natural <br />channel, including diversions from storage reser. <br />voirs, and its application to a beneficial use and <br />the creation thereby of legal rights to such diver.. <br />sion and use, as re.cognized and enforced generally <br />in states 'ihere irrigation is practised and where <br />the connnon law doctrine of riparian rights is not in <br />force: <br /> <br />. <br /> <br />llthooS.F'll <br />5 <br /> <br />13 <br /> <br />:.k <br />
