<br />0023tiU <br /> <br />DRAFT SUBDIVISION ORDINANCE <br /> <br />83 <br /> <br />5-420 <br /> <br />All other ordinances inconsistent with this ordinance <br /> <br />~ <br />~~,1 <br /> <br />are hereby repealed to.the extent of th~inconsistency <br /> <br />only. <br /> <br />2.4 Interpretation. In their interpretation and application, <br />the provisions of this ordinance shall be held to be mini- <br />mum requirements and shall be liberally construed in <br /> <br />favor of the governing body and shall not be deemed a <br /> <br />limitation or repeal of any other powers granted by <br /> <br />State statutes. <br /> <br />2.5 Warning_and Disclaimer of Liability. The degree of flood <br /> <br />protection required by this ordinance is considered <br /> <br />reasonable for regulatory purposes and is based on <br /> <br />engineering and scientific methods of study. This <br />ordinance shall not create liability on the part of <br /> <br />-lUame of local unit) <br />for any flood damages that result from reliance on this <br /> <br />or any officer or employee thereof <br /> <br />ordinance or any administrative decision lawfully made <br /> <br />thereunder. In no case shall responsibility or liability arise <br /> <br />from the design or operation of subdivision drainage <br /> <br />fad li ties dedicated to the city if the city has not accepted <br /> <br />in writing the dedication and agreed to maintain <br /> <br />t;~::i~ <br /> <br />and operate the facilities. <br />
