<br />REGULATORY PROGRAMS 0 [) 2 3 J4 <br /> <br />27 <br /> <br />5-.242.31 <br /> <br />~~ The Henrico County, Virginia, code states: <br />"~:t""- <br /> <br />Sec. 14~21. .Easements along natural watercourses. <br /> <br />Wherever a subdivision is traversed by a way <br />or place whose origin is the result of the forces <br />of nature, having a bed, sides, or banks through <br />which water flows continuously or intermittently <br />ina particular direction, and wherever a sub- <br />division is traversed by any'other way, place, or <br />device installed. to aid natural drainage and <br />which does not SUbstantially change the course <br />or direction of t.hef10w of water, there shall <br />be provided an easement conforming substantially <br />with the boundaries of such watercourse and such <br />further width as may be necessary for drainage <br />.. and utilities at this location ~146 <br /> <br />6. For example,. a Davenport, :rowa. <br />channel improvements: <br /> <br />ordinance requires <br /> <br />.VlJ:lenever any stream or important surface water <br />course is located in an area that is being <br />subjivided., 'the sUbdivider shall at his own <br />expense make adequate provision for straighten- <br />ing or widening"the channel so that it will <br />properly carry surface water and shall also <br />provide and dedicate to the City of Davenport an <br />easement along each side of the stream, which <br />easement shall be for the purpose of widening, <br />improving, or protecting the stream and for <br />. recreational use. The width of such ecsement <br />shall not be less than twenty (20) feet and the <br />total width of the easement shall be adequate to <br />provide fer any necessary channel relocations <br />and strafghtening. 147 <br /> <br />A Greensboro, North Ca,rolina, ordinance, provides in its des- <br />cription of design standards for planned unit development: <br /> <br />(a) Flood Plain Excluded. Limd within the flood plain <br /> <br />of any watercourse, as determined by the director of <br />Public Works of the City shall not be considered <br />as part of the gro~s acreage for computatio~4~f the <br />maximum number of lots which may be created. <br />
