<br />., <br /> <br />002342 <br /> <br />. <br /> <br />. <br /> <br />\ <br /> <br />Two weeks after the Board's meeting, the Defenders of Wildlife, on June 28'h, filed in Washington <br />D,C. court filed their action against the Department of the Interior, CommissionerofReclarnation, Director <br />of the V.S, Fish and Wildlife Service, National Marine Fisheries Service and the Department of <br />Conunerce. The suit alleges that the Federal agencies are in violation of the Endangered Species Act <br />(ESA) and the Administrative Procedures Act (APA), <br /> <br />The suit alleges that Reclamation and the USFWS failed to consider the impact of their actions <br />beyond the 5-year period stated in the Biological Opinion, which is in violation of the ESA, and that <br />Reclamation and the USFWS failed to consider the impacts oftheir actions on species in Mexico, The suit <br />requests the court to: declare that the defendants are in violation of the ESA; require Reclamation to <br />prepare a Biological Assessment that includes species in Mexico; consult with the USFWS and National <br />Marine Fisheries Service regarding species in Mexico; and require the USFWS to issue a recovery plan <br />for the southwestern willow flycatcher. <br /> <br />Counsel for the California agencies and the Attorney General's office met via conference call on <br />Monday to discuss how best to proceed. Key issues include requesting a change in venue from <br />Washington D.C, to the west and the best procedure for intervention.
