<br />, <br /> <br />.' <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />C. The State agrees that it shall: <br /> <br />1. Pay as compensation for the services of the Contractor <br />the sum of Ninety-Five thousand Dollars ($95,000) in the <br />following manner: <br /> <br />a. Ninety-five percent (95%) Ninety Thousand Two Hundred Fifty <br />Dollars ($90,250) of the total due based upon a statement, <br />and review and approval by the State pursuant to the Scope <br />of Services (Exhibit A), of the percentage of the work <br />actually completed for each task as of the last day of each <br />month. The breakdown of the entire lump sum fee by task <br />including expenses is as follows: <br /> <br />Task 1 $ 7,030.00 <br />Task 2 $ 6,870.00 <br />Task 3A $ 10,490.00 <br />Task 3B $ 8,130.00 <br />Task 4 $ 30,230.00 <br />Task 5 $ 27,250.00 <br />Task 6 $ 5.000.00 <br /> <br />b. The remaining five percent (5%), to wit Four Thousand Seven <br />Hundred and Fifty Dollars ($4,750.00), within thirty days <br />following receipt and acceptance of the final written report <br />as specified in Task 6 of the contract. <br /> <br />D. This contract is not assignable by the Contractor without <br />the prior written approval of the State. <br /> <br />E. The original contract price and any additions thereto shall <br />be adjusted to exclude any significant sums by which the <br />principal representative determines the contract price had been <br />increased due to inaccurate, incomplete or noncurrent wage rates <br />and other factual unit costs. The Contractor's Certificate <br />concerning Compensation is attached hereto as Exhibit D. <br /> <br />F. The professional engineer warrants that he has not employed <br />or retained any company or person, other than a bona fide <br />employee working solely for him, to solicit or secure this <br />contract and that he has not paid or agreed to pay any person, <br />company, corporation, individual, or firm, other than a bona <br />fide employee working solely for him, any fee, commission, <br />percentage, gift or other consideration contingent upon or <br />resulting from the award or the making of this contract. <br /> <br />G. The Contractor has identified Milenski Ag Consulting <br />Services (Bill Milenski), Colorado Researchers (sallye Wrye <br />Smith), Donald Nielson, Charles F. Cortese, Milliken Research <br />Group, Inc. (Gordon Milliken), and Kevin B. Pratt, Esq. as <br />subconsultants to be utilized in completing the product. <br />Contractor may not obtain the services of other subconsultants <br />or subcontractors unless the state gives its written approval. <br />All payments due any subcontractors or subconsultants shall be <br /> <br />Page ;1 of 1 Pages <br />
