<br />" <br /> <br />'" ..,r.- ": <br />.,)'i.JU <br /> <br />The above paragraphs in combination with the information provided <br />in response to the Chapter 4 requirements constitute a complete application <br />for the "Efficient Utilization of Water" permit. Submission of this <br />information for this permit does not admit that such a permit is an <br />activity of State interest, nor a permit within the jurisdiction of <br />Eagle County. Nevertheless, this permit request is submitted in the <br />good faith belief that the Cities are practicing the most practical and <br />reasonable level of water conservation. <br /> <br />Legal Reservations <br /> <br />The Cities respectfully submit this application for permits per <br />Resolution No. 80-25, Chapters 4 & 5 in the spirit of intergovernmental <br />cooperation. The Cities respectfully must make as a matter of record <br />certain legal reservations: <br /> <br />1) Submittal of this application is not to be construed as an <br />acceptance of the legal validity of CRS 1973, ~ 24-65.1-101, <br />et ~., (Supp. 1981) or the legal validity of Eagle County's <br />regulations, or a waiver of any subsequent legal proceedings <br />concerning validity. <br /> <br />2) Submittal of this application is not to be construed as an <br />acceptance of, or concession to Eagle County's jurisdiction <br />where the Home Rule powers of the Cities are supreme. <br /> <br />a) The Cities specifieally declare that submission require- <br />ments (4-304 & 5-306) which apply to the development <br />area, and which apply to the Cities of Colorado Springs <br />and Aurora within their corporate boundaries are not <br />legally applicable to the Cities. This declaration <br />includes, but is not l1mited to Chapters, 4 & 5 ~ 304 5 <br />(b), (c), (d), (e), (f), (i). 6, ~a), (i), (vi), (vii), <br />(viii), (x), (xi). 7 (c). 8., & s 306 1,(s) <br /> <br />b) The Cities believe that the primary purpose of this <br />application and permitting process is to identify and <br />mitigate adverse impacts of this project occurring within <br />Eagle County, and which are off Forest Service Lands, and <br />that Eagle County authorities have no desire to assume <br />responsibilities for activities within the corporate <br />boundaries of the Cities. <br /> <br />3) Submittal of this application is not to be construed as an <br />acceptance of Eagle County's land use jurisdiction over United <br />States Forest Service lands. <br /> <br />4) Submittal of this application is not to be construed as a <br />waiver of any claim, cause of action or other right to relief <br />or remedy by the Cities under any laws of the State of Colorado. <br /> <br />24 <br />
