<br />002353 <br /> <br />. <br /> <br />. <br /> <br />Board, and the Steering Committees contract manager. the National Fish and Wildlife Foundation. <br />Only one response to the RFP was received which came from ajoint-venture of Science Applications <br />International Corporation (SAIC) and Jones & Stokes (1&S). <br /> <br />A review team, including Messrs. Zimmerman and Harris, was given the task, by the Steering <br />Committee, to review the proposal, schedule an interview, and prepare a recommendation for <br />Steering Committee approval at its October 26'h meeting in Las Vegas, Nevada. <br /> <br />Mr. Harris, as the MSCP Point-of-Contact (POC), is coordinating the transition and transfer <br />of all data, equipment and work products from the Ogden Team to the Board. Mr. Harris will also <br />provide liaison services between the Ogden Team and the new consultant tcam after they are hired <br />and initiate work. <br /> <br />Additionally, the MSCP Program Subcommittee and POC are working with the MSCP <br />Facilitation Consultant Team in the identification of critical path issues and schedule modification. <br />This important step is required in order to expedite the initiation of work by the new consultant team, <br />as well as ensuring that members of the Steering Committee are aware of the short time frame <br />remaining in which to complete Program development. <br /> <br />Defenders of Wildlife v. Babbill <br /> <br />As the Board is aware, the Lower Division States moved to intervene in this lawsuit. <br />Additionally, Colorado River water and power users and providers in the three states also moved to <br />intervene. A list of the interveners is included in the Board folder for your information. <br /> <br />The plaintiffs (Defenders of Wildlife, et a1.) filed a motion in opposition to the Intervener's <br />motions to intervene on September 25, 2000. Briefly, the plaintiffs state that the rationale for the <br />lawsuit is to ensure federal agency compliance with the Endangered Species Act (ESA) and the <br />National Environmental Policy Act (NEPA) and that "...none of the proposed interveners will be <br />affected at all by the narrow relief sought here ...the plaintiffs have no objection to the proposed <br />interveners participation as amicus curiae..." The plaintiffs also allege that many of the proposed <br />interveners do not meet the standing requirements for participation in the case as interveners. <br /> <br />On October 13,2000, U.S. District Court Judge James Robertson denied all of the motions <br />to intervene. [n his order denying the motions to intervene, Judge Robertson ruled that".. .none of <br />the proposed interveners can satisfy the 'injury in fact' requirement of Article III standing."
