The basis for determining when spills can be anticipated and the <br /> <br />annual releases from Lake Powell can be greater than 8.23 million acre-feet <br /> <br />to avoid anticipated spills in Article u(3)(c); <br />4. The release of water from Lake Mead in excess of Article 111(1) <br /> <br />requirements in anticipation of flood control releases. <br /> <br />In letters dated August 29, 1980 and November 4, 1980 from the Executive <br /> <br />Director of the Upper Colorado River Commission to R. Keith Higginson, the <br /> <br />Commissioner of the Water and Power Resources Service, the Commission <br /> <br />concluded that there was not a need for a formal review of the "Operating <br /> <br />Criteria" at that time. The Secretary of the Department of the Interior, <br /> <br />Cecil D. Andrus, in his letter to the Commission's executive director dated <br /> <br />December 10, 1980 indicated that "After assessing all comments received from <br /> <br />the Colorado River Basin States and other interested parties, we have con- <br /> <br />cluded that there are no specific issues or compelling needs for a formal <br /> <br />review this year.1I <br /> <br />In a letter dated October 5, 1985, Secretary of the Interior, Donald <br /> <br />Paul Hodel, indicated that a review of the Operating Criteria was warranted <br /> <br />citing ". . . the expressed concern over following the operating criteria, <br /> <br />the significant chance of high releases in anyone year under current condi- <br /> <br />tions, and the need to address the application of certain provisions of the <br /> <br />criteria, such as Section 602(a) storage requirements and the Colorado River <br /> <br />Simulation System (CRSS) Model."
