<br />~ <br /> <br />i <br /> <br />(4) Provide the water required for initial filling <br />and replenishment of evaporation losses of the recreation pool by <br />purchase or other means consistent with Federal and State laws, to <br />assure effective operation of the project for recreation with pro- <br />vision that the cost thereof for initial filling is eligible for <br />credit against the non-Federal obligation for assuming one-half the <br />separable costs for recreation and fish and wildlife enhancement. <br /> <br />I, <br /> <br />, <br />, <br />II <br />~ <br />I, <br />f: <br />, , <br /> <br />b. Hold and save the United States free from damages due <br />to water-rights claims resulting from construction and operation of <br />the project; <br /> <br />~ <br /> <br />c. Prevent encroachment on the flow-carrying capacity of <br />the Bear Creek Channel below the reservoir and the South Platte <br />River Channel below the confluence of Bear Creek to the extent nec- <br />essary to provide for effective reservoir operation in the interest <br />of flood control; <br /> <br />~ <br /> <br />d. Adequately inform effected interests, at least annually, <br />that the project will not provide complete flood protection; and <br /> <br />I: <br /> <br />e. Provide guidance and leadership in preventing unwise and <br />uneconomical future development of the flood plain areas by encourag- <br />ing prudent use of flood proofing, land regulation planning, or other <br />flood plain management techniques to reduce future flood losses. <br /> <br />, <br />'I <br />1 ' <br />I; <br /> <br />~ <br />~ <br /> <br />12. I also recommend that authority be granted to negotiate'with <br />the Colorado Department of Highways and the United States Bureau of <br />Public Roads for the payment or reimbursement, from project funds, of <br />the added costs for initial construction of the improved Colorado High- <br />way No. 70 along an alternative route around the reservoir site. The <br />added cost is currently estimated at $739,000. <br /> <br />~ <br /> <br />13. I further recommend that, following authorization of the <br />project, detailed site investigation and design be made for the pur- <br />pose of accurately defining the project lands required; that subsequently, <br />advance acquisition be made of such title to such lands as may be required <br />to preserve the site against incompatible developments, and participation <br /> <br />r <br /> <br />I' <br /> <br />I <br />I <br />~ <br />I <br /> <br />5 <br />
