<br />~.. ,.. ?~5 <br />'-' -" - --... <br /> <br />quantity of water diverted to each ownership category is as shown <br /> <br />on the enclosed Table II. <br /> <br />In May 1959, a concerted effort was undertaken by the Department <br /> <br />of the Interior to evict illegal occupants on Federal lands who <br /> <br />were using water without a contract as required by the Boulder <br /> <br />Canyon Project Act. Five initial instances of clearly illegal <br /> <br />occupancy of Federal lands and use of Colorado River water were <br /> <br />filed with the courts. <br /> <br />In April 1961, the Lower Colorado River Land Use Office was estab- <br /> <br />lished for the purpose of regularizing use of the Federal lands <br /> <br />by the 800 or more trespassers. The permit covering agricultural <br /> <br />lands states the following with regard to water: <br /> <br />"12 (a) In the event that the applicant diverts or pumps <br />Colorado River water in connection with the enjoyment of <br />the permit area such diversion or pumping by applicant during <br />the term of this permit or any extension thereof shall be <br />for essential beneficial use only and shall cease upon and <br />as provided by 30 days' written notice to applicant from <br />the Secretary of the Interior or the officer issuing the <br />permit that Colorado River water is no longer available <br />for use within the permit area. In the event that such <br />notice is given, applicant may terminate this permit. <br /> <br />(b) If the applicant diverts or pumps Colorado river <br />water for agricultural use, applicant shall give advance <br />notice of the daily water requirements for each period of <br />seven (7) consecutive days beginning Monday of each week. <br />Such notice shall be given not later than the Wednesday <br />preceding such Mo~day to the official of the Bureau of <br />Reclamation designated for that purpose by the officer <br />issuing the permit. Quantities specified in such notice <br />may be modified with the approval of the Bureau of <br /> <br />3 <br />
