The <br />Upper Niobrara and Big Blue River compacts are concerned <br />with both surface and groWld water usage. Interstate compacts <br />affecting the diversion and use of Colorado River Basin waters <br />also apply to and affect certain existing and projected diver- <br />sions for use in the North and South Platte river areas of the <br />Missouri Basin. An international treaty of long standing appor- <br />tions the waters of the St. Mary and Milk Rivers between the <br />United States and Canada. <br /> <br />SCOPE <br /> <br />Aside from a brief historical background, the treat- <br />ment of waler laws, policies. and administration in this <br />appendix is for the present situation. In this there is <br />recognition for the more recent and projected trends to <br />multiple-purpose structures and, most often, for their <br />integrated operation in meeting several functionaJ needs. <br />Also, for the broadening emphasis on regional and basin. <br />wide water reSource pIJnning and development within <br />each State and for the subbasins and Missouri River B:lsin <br />as a whole. These trends and the actions, both interstate <br />and intrastate, m3ke the legal and organizational prob- <br />lems more complex. Further, this requires the inter- <br />working of Illany elements of Federal and State laws <br />and policies at aJl stages of resourCe development and <br />management. While holding largely to the current sltua- <br />tiun, where existing leg::Jl or institutionaJ conslraints are <br />pointed up in chapters 3 and 4 this begins to indicate <br />opportunities or needs for consideration of adjustments <br />in the future. TIle needs and general nature of such <br />adjustments are pointed up also III the Appendix on <br />"Plan of Develupment and Management of Water and <br />Related Land Resources." However, detailed studies are <br />required as the basis for adjustments. <br /> <br />This appendix briefly summarizes in chapter 2 each <br />State's major provisions of water law and current organl- <br />zation::!1 structure in the field of waler resource planning. <br />development, and admilllstratlon. In many respects these <br />impinge on m::!lters of related land resource planning and <br />development. and such relatiunships are covered as ap- <br />propriate. TIle summaries were prepared by the respective <br />State ~ater resource agencies. Similarly the appendix <br />then sllmmarizes in chapter 3 the Federal water laws <br />and policies, and relates them generally to those of the <br />states. This summary was prepared by J special task <br />force designated by the Standing Committee on Com- <br />prehensive Basin Planning. Finally. in chapter 4 there are <br />summarized brieny problems in future w::Jter resources <br />jevelopment. As st::Jted under "PURPOSE" it is im- <br />possible to al"complish in the brief treatment herein a <br />fully accurate understanding or the Illany elements Jnd <br />workings of law, poliL'Y. and administrative provisions in <br />the field of water resources. Thus, beyond the brief <br />orientation and general understanding to be gained from <br />the following chapters. spednc water right problems <br />and related policy issues should be explored with legal <br />cOllnsel and state officials thoroughly versed in this field. <br />The material in this appendix is a collection of state- <br />ments on the law whlL'h outlines the particular organi- <br />zation's function in the water and related land resources <br />developmel.1t field. It was expected that each reporting <br />agency would lend its "'color tone" to 'the statement <br />submitted, just as such agency dues in the actual day-to- <br />day functioning in its operations. With this in mind, it <br />should be recognized by all that none of these statements <br />of law should be considered binding upon any other <br />organization which has contributed material for this <br />appendix. This caveat should suffice to serve as pro- <br />tection. if indeed this is needed. to those who may <br />disagree With a particular presentation, yet have not <br />objected. <br />
