CORPS OF ENGINEERS <br />650 CAPITOL MALL <br />SACRAMENTO, CAUFORNIA 95814 <br /> <br />REPLY TO <br />ATTENTION OF <br />SPKCO-O <br /> <br />PUBLIC NOTICE NO. 6268 <br /> <br />TO WHOM IT MAY CONCERN: <br /> <br />Application has been made to this office by the Bureau of Reclamation, Upper Colorado <br />Region. P.O. Box 11568, 125. South State Street, Salt lake City, Utah 84147, for a Department of <br />the Army Permit to construcl an earthfill dam on the Dolores River, Sec. 1 and 2, T.JaN, R,16W <br />(NMPM), Montezuma County, Colorado, as shown on the attached drawings. <br /> <br />The dam will be a rolled earth, sand, gravel, and rockfill structure with a volume of <br />approximately 5,029,000 cubic yards. The impounded reservoir water will be used for irrigation, <br />municipal and industrial, recreation. and fish and wildlife purposes. <br /> <br />Application has been made 10 the Environmental Protection Agency for a National Pollutant <br />Discharge Elimination System (NPDES) Permit, in accordance with Section 402 ot era I <br />Water Pollution Control Act Amendments of 1972. <br /> <br />A Draft Environmental Statement (DES) dated 1 November 76, entitled "Dolores <br />Colorado," has been prepared by the Department of the Interior, Bureau on. A <br />copy of the DES is available for review at the Bureau of Reclamation Office noted above. <br />Additional information can be obtained from Mr. Wayne E. Cook, P.O. Box 640,835 Second <br />Avenue, Durango, Colorado 81301, or telephone (303) 247-0247. <br /> <br />The National Register of Historic places has been reviewed and there are no places either listed <br />or recommended as eligible which would be affected by the proposed construction. This review <br />constitutes the extent of the cultural resource investigation by the Sacramento District Engineer. <br />The Sacramento District Engineer is unaware of the presence of any such resources. <br /> <br />Any person who has an interest which may be adversely affected by the issuance of this permit <br />may request a public hearing. The request mUSl be submitted in writing to the District Engineer <br />within thirty days of the date of this notice and must clearly set forlh the interest which may be <br />adversely affected and the manner in which the interest may be adversely affected by the <br />activity. Other interested parties who are not necessarily adversely affected are invited to submit <br />in writing, on or before 13 June 1977, any comments they may have on the proposed work. <br /> <br />A permit issued by the Deparlment of the Army does not give any property rights either in real <br />estate or material or any exclusive privileges and does not aulhorize any injury of privale <br />properly or invasion of private rights, or any infringement of Federal, State or local laws or <br />regulations, nor does it obviate the necessity of obtaining State assent to the work authorized. <br /> <br />The decision whether to issue a permit will be based on an evaluation of the probable impact of <br />this aClivity on lhe public interest Evaluation will include application of guidelines set forth by <br />the Administrator, EPA, under authority of Section 404 (b) of the Federal Water Pollution <br />Control Act. That decision will reflect the national concern for both protection and utilization of <br />important resources. The benefit which reasonably may be expected to accrue from the <br />proposal must be balanced against its reasonably foreseeable detriments. All factors which may <br />be relevant to the proposal will be considered; among those are conservation. economics, <br />aesthetics, general environmental concerns, historic values, fish and wildlife values, flood <br />damage prevention, land use classification, navigation, recreation, waler supply, water quality <br />and in general, the needs and welfare of the people.
