<br />(i) be a utility, primarily engaged in <br />retail or wholesale sales of <br /> <br />, <br />electricity, with power supply <br />responsibility for the load to be <br /> <br />served; or <br /> <br />(ii) Be a Federal or State ultimate <br /> <br />consumer type load, including such <br /> <br />loads of State agencies whose use of <br /> <br />power enhances the available Federal <br /> <br />power resource; or <br /> <br />(iii) Be an existing Western contractor for <br /> <br />long-term firm power who does not <br /> <br />otherwise qualify above; or <br /> <br />(iv) Have taken significant and tangible <br />steps to acquire the means to <br /> <br />distribute power or have taken initial <br />steps to acquire the means to <br /> <br />distribute power and have requested an <br /> <br />extension of time for taking <br /> <br />significant and tangible steps. <br /> <br />The proposed criteria will be modified to indicate <br /> <br />, <br /> <br />that proposed allocations of capacity and energy <br />to any existing customer who fails to demonstrate <br />compliance with the spirit of the resale of <br /> <br />electric energy article in its current contract <br /> <br />79 <br />
