What is tbe basis for claim of "assured" "dependable water supplies" (page 16 of
Public Information Packet) wben you state that the volume of in-flow to the Monument has not changed
significantly (pages 13,14)7

3a. CRWCD; p2, '3. 4. This.scoping process has been noticed to the public and to state/local
agencies as necessary prior to initiating negotiations on the contract referenced above. The contract
must be limited to serving the legitimate needs of BCNM. While it is appropriate to consider the
requests of the U.S. Fish & Wildlife Service (FWS) for flows to augment endangered fish habitat on
the lower Gunnison Rive during the process, it must be recognized that the amounts of water requested
by NPS and FWS require separate and distinct justifications.

3a.

CRWCD; p3,'2.

6. The water needs of BCNM must be stated with specificity.

3a. GREENO+; p4, '4. Issue B Wilderness Reserved Water Ri.ht - The 1933 reserved right for
Monument purposes is reinforced and complemented by a 1976 reserved right for wilderness purposes..
Congress designaled most of the Monument (including tbe length. of the Gunnison River through tbe
Monument) as a wilderness area wider t1ie terms of the Wilderness Act in 1976. Wilderness Act
purposes include preservation of naturalness, solitude, and opportunities for primitive recreation as well
as scientific, scenic, and other supplemental values. Satisfaction of the wilderness reserved water
precludes any post-1976 water applications (e.g., AB Lateral) that would divert substantial quantities of
water upstream from the Monument or that would impair high spring/summer and low winter/fall flow
regimes.

3a.

GREENO + ; p4, '6. Issue C Protection of Monument Values - The federal government's .reserved
water rights under the purposes of the Organic Act, the 1933 Proclamation, and the Wilderness Act are
meant to protect specific environmental and social values...

(;,:;;:;~:\

3a.
