readers new and revised text Changes will be made as appropriate, and the FEIS will be prepared
for release, The FEIS will include comment letters, the responses to comments, and those pages
with text changes,

10. ISSUE IDENTIFICATION AND DISPUTE RESOLUTION

Unresolved issues can lead to misdirection of effort, and delays in the preparation of the EIS,
It is in the interest of all parties to this effort that any issues or problems be identified and resolved at
the lowest level of decision making, and in the most expeditious manner as possible, The process of
dispute resolution is generally referred to in the description for the EIS program management (see
previous section 8. "Process/Program Management"), For instance, if a dispute occurs the
Management Team will attempt to reach consensus with the involved parties, and if consensus is not
reached. the party(s) which do not agree can request a review and decision by the Project Sponsors,

As the lead federal agency for NEP A compliance, Reclamation is responsible for all final
decisions relating to the Navajo Reservoir Operations EIS, Reclamation will make all reasonable
efforts to resolve issues with the cooperating agencies in a collaborative and timely manner. For
disputes involving different interpretations of information, Reclamation will consider all information
before making a final decision,

Although this POA sets forth a cooperative process, Reclamation recognizes that each
cooperating agency has statutory and contractual responsibilities, This POA does not. and is not
intended to, abrogate any of the cooperating agencies' responsibilities to carry out their individual
legal responsibilities, mandates. or contractual obligations,

16

:1
