As used in NRS 538.040 to 538.260, inclusive, "commission" means the Colorado River commis- sion of Nevada. 538.050 Creation of commission; number of commissioners. A commission is hereby created, to be known as the Colorado River commission of Nevada, consisting of five commissioners: The direc- tor of the state department of conservation and natural resources, and four commisRioncrs to be appointed by the governor. . [Part 1:71:1935; 1931 NCL ~ 1443.01]-(NRS A 1963, 982) 538.060 Qualifications of appointed oommissioners. 1. Each appointcd commissioner shall have the following quali- fications: (a) Ho shall be a citizen of the State of Nevada and a resident therein for at least 5 years. (b) He shall have a general knowledge of the development of the Colorado River and its tributaries within the State of Nevada. (e) He shall have general knowledge of tbe rights of the State of Nevada insofar as the same pertain to the waters of the Colorado River allocated or allotted to or contracted by the State of Nevada, and insofar as the same pertain to the acquisition and distribution of the electrical power belonging or allotted to or contracted by the State of Nevada and gencrated at Hoover Dam and other hydro. electric power facilitie-s on the Colorado River. 2. Not more than three commissioners shall bc of the same major political affiliation. Within 30 days after March 20, 1935, the governor shall appoint four commis- sioncrs. Two of the commissioners shall hold office for terms of 2 years, and, hvo of the commissioners shall hold office for terms of 4 years. Thereafter appointmcnts shall be made for terms of 4 years. All appointed commissioners shall hold office until their successors are appointed and qualified. [Part 1:71:1935; 1931 NCL ~ 1443.01]-(NRS A 1959, 851) 538.080 Remo"als and vaoancies. 1. 'l'he governor may at any time remove any commissioner for neglect of duty or malfeasance in office. 2. Any vacancy shall be filled by a.ppointment by the governor for the unexpired term. All commissioners shall give bond to the State of Nevada for the faithful performance of their duties, in such sum as the state board of examiners shall, from time to time, dircct.
