irrigation season were not in accordance with the operating principles and by letter dated

September 24, 1993, directed the District to immediately change the stockwater releases to the

rate specified in the operating principles until the operating principles are amended to allow a

higher rate of release. The Colorado State Engineer also advised Kansas of his conclusions and

directives to the District by letter dated September 24, 1993. Subsequent to the Colorado State

Engineer's determination of no overstorage and directive to change the stock water releases, the

District committed to changing the stockwater releases and again requested Reclamation to

approve the amended operating principles.

Kansas responded to the Colorado State Engineers September 24, 1993 letter on

November 16, 1993. Kansas again concluded that in 1992 the storage in Trinidad Reservoir

exceeded the limits authorized by the operating principles. Kansas also agreed that the District

had not released the stockwater in accordance with the operating principles. Kansas reconfirmed

its request that Reclamation not approve the amended operating principles as operations in the

past and presently continue to deviate from the operating principles. The Colorado State

Engineer responded to Kansas' letter of November 16, 1995 alleging continuing violations of the

operating principles on December 2, 1993 with an explanation of the accounting for stockwater

releases in his analysis of storage in Trinidad Reservoir from November I, 1988 through October

1993.

After considering the positions of Colorado and Kansas, the ARCA took no action

concerning the proposed amended operating principles at its annual meeting in December 1993.

Neither the AReA nor Reclamation took any further action to approve proposed amended

operating principles for the Project until the operating principles were amended to enlarge the
