Clarifies that <br />a proposed plan for augmentation that relies on water that is, by contract or <br />~therwise, of l~mited duration shall not be denied solely on the ground that <br />::he augmentation water is of a limited duration so long as the terms of the <br />plan prevent injury to vested water rights. <br /> <br />APPROVED by Governor March 25, 1996 <br /> <br />EFFECTIVE March 25, 1996 <br /> <br />H.B. 96-1283 Property tax valuation of superfund water treatment <br />facilities. States that the income approach to appraisal shall be considered <br />the primary indicator of the value of superfund water treatment facilities. <br />Requires that;the cost approach or market approach to appraisal be used to <br />value superfu~d water treatment facilities only if the value determined under <br />the cost appr9ach or market approach is less than the value determined under <br />the income approach to appraisal. Requires the assessor to capitalize the <br />actual income generated by the property at 10% per annum. Adds any gathering that <br />convened e~ectronically to discuss public business to the definition of <br />"meeting" . Modifies the definition of "state public body" with regard <br />governing boards of state institutions of higher education. . <br /> <br />Specifies that the minutes of an executive session of a state pub <br />body or local public body reflect the topic, rather than the general top <br />of discussion. Requires that state and local public bodies announce <br />topic of discussion in the executive session before voting or holding sue <br />session. <br /> <br />Spec~fies that a conference must be with an attorney representing <br />public bqdy in order for such conference to occur in an executive sese <br />Limits when an executive session may be held to develop strategy and reI <br />=eports on the progress of negotiations to only negotiations with emplo <br />or employee organizations. Prescribes open meeting requirements for a s <br />committee of a state public body or local public body, including discI <br />of final'ists. <br /> <br />
