<br />This solicitation may be awarded without discussion of proposals received; <br />therefore, each one should be submitted to the most favorable terms from a <br />price and technical standpoint, which the offeror can submit to the Government. <br /> <br />5.2 UNNECESSARILY ELABORATE PROPOSALS - Unnecessarily elaborate brochures <br />or other presentations beyond that sufficient to present a complete and <br />effective proposal are not desired and may be construed as an indication of <br />the offeror's lack of cost consciousness. Elaborate art work, expensive paper <br />and bindings, or expensive visual and other presentation aids are neither <br />necessary nor wanted. <br /> <br />5.3 RESTRICTIONS ON DISCLOSURE AND USE OF DATA IN PROPOSALS AND QUOTATIONS - <br />If offeror does not want the date submitted disclosed to the public or <br />used by the Government for any purpose other than evaluation, he shall mark <br />the title page with the following legend: <br /> <br />This data, furnished in connection with Request for Proposal <br />Number , shall not be disclosed outside the <br />Government and shall not be duplicated, or used, or disclosed <br />in whole or in part for any purpose other than to evaluate the <br />proposal; Provided, That if a contract is awarded, the Government <br />shall have the right to duplicate, use or disclose the data to <br />the extent provided in the contract. This restriction does not <br />limit the Government's right to use information contained in the <br />data if it is obtained from another source without restriction. <br />The data subject to this restriction is contained in sheets <br /> <br />The offeror shall mark each sheet of the data which he wishes <br />to restrict with the following legend: <br /> <br />Use or disclosure of proposal data is subject to the restriction <br />on the title page of this proposal. <br /> <br />Offerors are cautioned that disclosure of data so restricted may <br />be required to be released to other parties under the Freedom of Information <br />Act as amended by Public Law 93-502 (November 21, 1974). However, it is <br />not the intent of the Water and Power Resources Service to voluntarily make <br />the restricted data available to other parties unless required to do so <br />under the provisions of the Freedom of Information Act as amended. <br /> <br />5.4 RETENTION OF OFFERS - Offers submitted in response to this solici- <br />tation, will not be returned but will be retained by the Government for <br />official record purposes. <br /> <br />5.5 DISPOSITION OF PROPOSAL MATERIAL - RFP material supplied to the <br />offeror including attachments and specifications shall not be returned <br />to the procuring office but maybe disposed of at the discretion of the <br />offeror. <br /> <br />5.6 CAPABILITY SURVEY - If an offer submitted in response to this <br />RFP is favorably considered, a survey team may contact your facility to <br />determine your financial and technical ability to perform. Current financial <br />statements and other pertinent data should be available at that time. <br /> <br />C-6 <br />
