Water Conservation Board
September 28, 1989
Page 3

The second water right which MCMD proposes to store in Bear Creek Lake is the
monthly streamflow depletion attributable to the historic irrigation use of a part of the
Robert LewIs Ditch. MCMD owns 223.595 inches out of the total 652.8 inches (34.25%)
decreed to this right, which has an appropriation date of 10-01-1865. Of this amount,
179.525 inches have been decreed by the Division 1 water court for use in a plan of
augmentation to support municipal uses in the District (Case No. 84CW221), In this
decree, Bear Creek Lake was also named as an alternate paint of storage for the Robert
Lewis water. Using an analysis of the historic diversions. crop consumptive use and return
flow patterns, the monthly stream depletions were calculated for the 1949-1957 study period.
The average annual depletion during the irrigation season (storable inflow to Bear Creek
Lake) and the average winter return flow obligation. each calculated in accordance with the
terms and conditions of the decree in 84CW221 are shown in Table B.
