<br />3. The cost of construction and I'erpetual operation and maintenance of
<br />the Aspen aeservoir shall be a charge against the project and shall be paid
<br />from project revenues or as otherwise provided by the Congress of the United
<br />States.

<br />4. The Aspen Reservoir shall be completed before any water is diverted
<br />to Eastern Colorado by means of the project.
<br />
<br />5. The primary purpose of Aspen Reservoir is to furnish, in like manner
<br />2,8 if the project were constructed b,' a water conservancy district organized
<br />~u~suant to the laws of the State of Colorado, the water required for the pro-
<br />j,e(',~ion of vies tern Colorado water users by the provisions of Section 1, Chapter
<br />l72, Colorado SeSSion Laws, 1943, reading as follows: "provided, however, that

<br />6. The replacement capacity of the Aspen Reservoir is that portion of
<br />the total reservoir capacity required to protect existing rights to the use of
<br />water in Western Colorado for domestic, irrigation, and manufacturing purposes
<br />(inclUding pm1er generation) and hereafter acquired rights to the use of water
<br />j,n Western Colorado for domestic, irrigation, and manufacturing purposes
<br />(excluding power generation) against alY and all losses of needed water because
<br />of stream depletions resulting from project operations. In the determination
<br />of such replacement capacity, consideration shall be given to, but not neces-
<br />sarily limited to, needs for water for the following purposes, such needs, how-
<br />ever, not to be for quantities in excess of those qu~tities of water which
<br />"'0 uld have been available from the Roaring Fork Hiver to supply such needs if
<br />the project had not been constructed:
